1.1  XYZ Business Pty Ltd (the Employer) employs the Employee on the terms and conditions set out in this contract.

1.2  This contract is subject to the minimum entitlements in the Fair Work Act 2009 (Cth), the National Employment Standards (NES), and the applicable Modern Award (the Award). It cannot provide for conditions less favourable than those minimum entitlements.

1.3  Where this contract is silent on any matter, the Award and the NES will apply. This contract supersedes any prior verbal or written arrangements between the parties.

2.1  The Employee is engaged in the role of [Position] and is expected to:

• Perform all duties typical of the Award classification listed above
• Comply with all reasonable and lawful directions of the Employer
• Maintain all licences, certificates, and registrations required for the role
• Perform all work to the applicable Australian Standards and the Employer's WHS Policy & Manual
• Represent the Employer professionally on client sites and in all business dealings

2.2  The Employer may reasonably vary the Employee's duties from time to time to meet operational requirements.

3.1  The Employee's ordinary hours are 38 per week, worked Monday to Friday, with a 30-minute unpaid meal break.

3.2  Reasonable additional hours may be required. Overtime is paid in accordance with the Award.

4.1  The Employee will be paid at the rate prescribed for the Award classification listed above. Verify before signing: if signing on or after 1 July, confirm the current rate at fairwork.gov.au and update this figure if it has changed.

4.2  The Employer will pay superannuation contributions in accordance with the Superannuation Guarantee (Administration) Act 1992 (Cth) at the prevailing statutory rate.

4.3  All applicable Award allowances will be paid in accordance with the Award. Wages are paid weekly by electronic funds transfer to the Employee's nominated account.

5.1  The Employee is entitled to annual leave, personal/carer's leave, compassionate leave, parental leave, and family & domestic violence leave in accordance with the NES.

6.1  Either party may terminate this contract by providing the period of notice required under the NES. The Employer may terminate without notice in cases of serious misconduct.

Welcome to XYZ Business Pty Ltd. This handbook sets out our workplace policies, expectations, and your entitlements as an employee. Please read it carefully and keep it for future reference. If you have any questions, speak with your manager.

This handbook supplements your Employment Contract and the applicable Modern Award. Where any inconsistency exists, your Employment Contract, the Award, and the Fair Work Act 2009 (Cth) take precedence. This handbook may be updated from time to time.

1.1  Ordinary hours are 38 per week, Monday to Friday, as outlined in your Employment Contract.

1.2  If you are unable to attend work, contact your manager as early as possible — and no later than 30 minutes before your scheduled start time.

1.3  Unexplained absences will be treated as unauthorised leave and may result in loss of pay for the period of absence.

2.1  All employees must accurately record all time worked. Timesheets must be submitted each week.

2.2  Falsifying time records constitutes serious misconduct and may result in immediate termination. Payslips are issued electronically within one business day of each payment.

3.1  Submit annual leave requests at least 5 business days in advance for short periods, and 4 weeks in advance for longer periods.

3.2  Personal/carer's leave, compassionate, parental, and family & domestic violence leave are available in accordance with the NES.

4.1  Employees have the right to disconnect from work-related contact outside their ordinary hours, in accordance with the Fair Work Act 2009 (Cth). The Employer will not take adverse action against any employee for reasonably exercising this right.

All employees are expected to treat colleagues, clients and suppliers with courtesy and respect, arrive on time and fit for work, perform duties with care and diligence, and raise concerns through appropriate channels.

No employee may attend work or operate machinery while under the influence of alcohol or drugs. The Employer reserves the right to conduct testing on worksites.

The health, safety, and welfare of our people is our highest priority — above productivity, cost, or schedule.

This policy applies to all work conducted at our premises, on client sites, in Employer vehicles, and at any other location where work is performed on our behalf.

3.1 The Employer (PCBU) has a primary duty to ensure, so far as is reasonably practicable, the health and safety of workers and others. This includes:

• Providing and maintaining safe plant, equipment, and systems of work
• Providing information, training, instruction, and supervision to work safely
• Consulting workers on matters affecting their health and safety
• Investigating all incidents and near misses and implementing corrective actions
• Identifying, assessing, and controlling psychosocial hazards

3.2 Employees and Workers must take reasonable care for their own and others' safety, comply with WHS instructions, wear all required PPE, and report all hazards, near misses, and incidents to their supervisor immediately.

3.3 Subcontractors and Visitors must comply with this policy while on our worksites and provide evidence of relevant WHS induction, insurance, and qualifications on request.

4.1  XYZ Business Pty Ltd recognises its obligation to identify, assess, and control psychosocial hazards — including bullying, harassment, excessive workload, and traumatic incident exposure — in the workplace.

5.1  Hazards are managed using the hierarchy of controls: eliminate the hazard where possible, then substitute, isolate, apply engineering and administrative controls, and provide PPE as a last line of defence.

6.1  All incidents, injuries, near misses, and hazards must be reported to a supervisor immediately. Notifiable incidents will be reported to the relevant WHS regulator as required by law.

7.1  Workers must be familiar with emergency exits, assembly points, and first-aid arrangements at each site. Emergency procedures are reviewed regularly.

XYZ Business Pty Ltd (ABN: 52 486 291 004) is committed to protecting the privacy of all individuals whose personal information we collect, hold, use, or disclose in the course of conducting our business. This policy is established in compliance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

• Employment application forms, contracts, and onboarding documentation
• Service agreements and client intake forms
• Timesheet, payroll, and HR systems
• WHS incident reports and training records

Personal information is stored securely in password-protected systems with access limited to authorised personnel, and in locked physical files. Information is retained only as long as required, then securely destroyed or de-identified.

We do not sell personal information. We may disclose it to payroll and accounting providers, regulatory bodies as required by law, workers' compensation insurers, superannuation funds, and professional advisors bound by confidentiality.

Individuals may request access to, or correction of, the personal information we hold about them. Complaints about a breach of the APPs will be acknowledged and investigated promptly, and may be escalated to the OAIC.

This policy governs the acceptable use of all Employer-provided devices, vehicles, tools, equipment, and information systems. Its purpose is to protect the security and integrity of Employer assets, data, and systems, and to set clear expectations for responsible use by all employees and contractors.

This policy applies to all employees, contractors, and any other person provided with, or who has access to, Employer-provided equipment or systems. This includes:

• Mobile phones, tablets, laptops, and desktop computers
• Employer vehicles
• Tools and specialised equipment
• Job management software and apps
• Email accounts and cloud storage systems
• Social media accounts operated by the business

3.1  All Employer-provided devices and systems must be used primarily for legitimate business purposes. Incidental personal use is permitted provided it does not interfere with work or breach this policy.

3.2  Employees must keep all software up to date and use strong, unique passwords. Passwords must not be shared.

3.3  All work-related documents and data must be stored in the Employer's approved cloud system, not on personal devices or accounts.

3.4  Any lost or stolen device must be reported immediately. Remote wiping may be applied without notice.

4.1  Employer vehicles are for business use only unless prior written approval has been obtained. All drivers must hold a current, valid licence at all times.

4.2  Drivers must comply with all road rules. Traffic infringements are the personal responsibility of the driver. Smoking, vaping, alcohol, and drugs in Employer vehicles are strictly prohibited.

5.1  Employer tools and equipment must be used for their intended purpose and in accordance with the manufacturer's instructions and relevant Australian Standards.

5.2  All tools and equipment must be inspected before use. Defective or unsafe equipment must be tagged out of service and reported immediately.

6.1  The Employer may monitor the use of its devices, systems, vehicles, and accounts to the extent permitted by law. A breach of this policy may result in disciplinary action up to and including termination.

1.1  The Principal engages the Contractor as an independent contractor (not as an employee) to perform the Services described in this agreement and any associated work orders.

1.2  The Contractor is not entitled to employee benefits, including annual leave, personal leave, redundancy pay, or notice periods under the NES.

1.3  The Contractor is responsible for their own income tax obligations and must hold a current ABN.

2.1  The Contractor will perform the Services to a professional standard, in accordance with all applicable Australian Standards, building codes, and regulations, and the Principal's site safety requirements and WHS policy.

2.2  The Contractor must hold and maintain all licences, registrations, and certifications required by law.

2.3  The Contractor must carry current public liability insurance and evidence this prior to commencement and on request.

3.1  The Principal will pay the Contractor at the rate agreed in each work order. The Contractor will submit valid tax invoices quoting a current ABN.

3.2  Valid invoices are paid by electronic funds transfer within the agreed payment terms. The Contractor is solely responsible for all tax obligations including income tax and GST.

4.1  The Contractor is a PCBU under WHS law and must comply with the Principal's site safety requirements and WHS Policy, and complete a site induction before commencing work.
